Course Program
The course is divided into two parts:
(i) consumer law;
(ii) regulation in civil law, with particular attention to the role of the so-called independent authorities.
In the first part, the following topics will be addressed:
- consumer law in the Italian-European dimension;
- the consumer and the professional;
- consumer education and information;
- unfair commercial practices;
- unfair terms in contracts between professional and consumer;
- protective nullities;
- injunctive and administrative protection against unfair terms;
- the sale of goods;
- contracts concluded outside business premises;
- online contracts and e-commerce;
- consumer credit;
- the protection of the investor, the saver, and the insured;
- timeshare contracts;
- access to justice, ADR, and class action.
In the second part, the following topics will be addressed:
- market regulation;
- the “conformative” powers of the so-called independent authorities;
- effects on contracts, acts of autonomy, and the conduct of operators;
- the “protective” matrix of civil law of regulation and the “pro-competition” one;
- regulatory powers of the AGCM and the conformative effectiveness of the contract;
- the conformative powers of supervisory authorities in the banking and financial sector: the impact of product governance on enterprises and contracts;
- civil law of regulation in the insurance market: enterprise and contract.
